1.1. The fact of accessing, navigating or using the services and contents of the Website implies that the User has read, is aware and fully accepts the Terms of Use without reservations. In this sense, the person who uses, navigates or accesses any of the contents and services offered on the Website will be considered as a User. The User agrees to use the Website in accordance with the Law and the established in these Terms of Use and the Privacy Policy published on the Website. The User shall refrain from any illegal or contrary to these Terms of Use in their use of the Website..

1.2. However, access to certain contents and the use and/or acquisition/provision of certain services is subject to specific Particular Conditions or General Contracting Conditions, which, in some cases, will replace, supplement and/or modify these Terms of Use, and in case of contradiction, the contradictory terms of the Particular Conditions or General Contracting Conditions will prevail over those established in these Terms of Use.

2. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS.

2.1.This Website is governed by national and international legislation on intellectual and industrial property.

2.2. In no case shall it be understood that the User's access and navigation of the Website or the use, acquisition and/or contracting of products or services offered through it, imply a waiver, transfer, license or partial or total assignment of such rights by Tienda de Padell.

2.3. Tienda de Padel is the owner or has obtained the corresponding license for the exploitation rights of intellectual and industrial property of Tienda de Padel as well as the rights and/or licenses of intellectual, industrial and image property on the contents and products available through it.

3.1. • Be false, ambiguous, inaccurate, exaggerated or untimely, so as to induce error about its object or the intentions or purposes of the communicator;

• Be protected by any intellectual or industrial property rights belonging to third parties, without the User having previously obtained the necessary authorization from their holders to carry out the use they make or intend to make;

• Violate the business secrets of third parties;

•Be contrary to the right to honor, personal and family privacy or the image of individuals;

• Infringe the regulations on the secrecy of communications;
• Cause, due to their characteristics (such as format, extension, etc.), difficulties in the normal operation of the Services

4. LICENSE FOR COMMUNICATIONS.

4.1. In the event that the User sends any type of information to Tienda de Padel through the Website, through the channels provided for this purpose on the Website itself, the User declares, guarantees and accepts that they have the right to do so freely, that such information does not infringe any intellectual property rights, trademark rights, patent rights, trade secrets, or any other rights of third parties, that such information is not confidential and that such information is not harmful to third parties.

Therefore, Tienda de Padel does not guarantee or is not responsible for: (i) the continuity of the contents of the Website; (ii) the absence of errors in such contents or products; (iii) the absence of viruses and/or other harmful components on the Website or on the server that supplies it; (iv) the invulnerability of the Website and/or the impregnability of the security measures adopted on it; (v) the lack of usefulness or performance of the contents and products of the Website; (vi) the damages or losses that may cause, to itself or to a third party, any person who infringes the conditions, rules and instructions established by Tienda de Padel on the Website or through the violation of the security systems of the same.

5.2 However, Tienda de Padel declares that it has taken all necessary measures, within its possibilities and the state of the technology, to guarantee the operation of the Website and to prevent the existence and transmission of viruses and other harmful components to Users. In this sense, Padel Store does not assume any responsibility for any aspect related to the website that establishes that link, specifically, by way of example and not limitation, on its operation, access, data, information, files, quality, and reliability of its products and services, its own links and/or any of its contents in general.

7. DURATION AND MODIFICATION. 

7.1. Tienda de Padel can change the terms and conditions laid out here, fully or partly, by posting any changes the same way these Terms of Use appear, through any kind of communication sent to users. 

7.2.The time these Terms of Use are in effect is the same as the time they are posted, until they are fully or partly changed, at which point they will go into effect in the modified Terms of Use. 

7.3. Regardless of what may be stated in specific conditions, the Paddle shop can end, suspend, or interrupt access to the website's content at any time without prior notice, and the user will not be able to claim any compensation. After this termination, the prohibitions for using the content previously outlined in these Terms of Use will still be in effect.

8. GENERALITIES.

8.2. If any provision or provisions of these Terms of Use are deemed invalid or unenforceable, in whole or in part, by any court, tribunal, or administrative body, such invalidity or unenforceability will not affect the other provisions of the Terms of Use. 

8.3. Tienda de Padel failure or execution of any right or provision contained in this legal notice will not constitute a waiver of it, unless acknowledged and agreed to in writing by Tienda de Padel.

9. CONSUMER GOODS WARRANTY In case of a defective product, the seller must proceed to replace or terminate the contract, which will be free of charge for the consumer. The seller is responsible for non-conformities that appear within two years from delivery. The consumer must inform the seller of the non-conformity within two months of having knowledge of it. Previously, and since Paddle Shop is informed about the defective product, it will go through a quality control in which it is distinguished whether the defect corresponds to the use of the item or a manufacturing defect. 

10. JURISDICTION. These General Conditions are governed by the law of the Republic of Panama. The parties submit, at their choice, for the resolution of conflicts and with waiver of any other jurisdiction, to the courts and tribunals of the user's domicile. Also, as an entity adhered to THE CONSTITUTION OF THE REPUBLIC OF PANAMA and in the terms of its DATA PROTECTION LAW, in case of controversies, the user may go to the competent courts within the Republic of Panama.
